Fair Debt Collection Practices Act and Creditor Harassment
In 1978, Congress passed the Fair Debt Collection Practices Act (FDCPA). The act was designed to halt unfair debt collection practices and provide some safeguards and remedies for consumers.
The types of debt collector activities, which are not allowed, include:
- The use, or threat of the use, of violence or harm to a person or business' reputation or property
- The use of profane language
- The publication of a list of consumers who refuse to pay debts, except under specific circumstances
- The use of repeated telephone calls intended to annoy, abuse or harass
