A construction dispute involving a lien is typically handled in civil court. Many of our clients have the following questions:
- Can I put a lien on the owner's property? The answer is "perhaps." Was the owner negligent in some way? Did you honor your end of the contract? Is that fact in dispute?
- Can I put a lien on the contractor's equipment? The answer is "perhaps." If the contractor did not perform up to the agreed upon standards, the work was shoddy or deadlines were not met, you may have a good case.
- How do I remove the mechanic's lien, property lien or materialmen's lien? There are a number of factors to consider including whether or not the lien was properly executed in the first place.
