Recent Review
“This review was a MUST for me. It was my first experience in any kind of court; I worked extensively with the Roger G. Jain & Associates staff on my case. They were more than kind and never left my side; walking me through the process step by step, providing exactly what I needed for each day. They were more than patient with me and extremely professional. [They have] a way of communicating which put my mind at ease, and relieved the stress I was under and helped me feel supported. Key points: they were persistent and timely, they kept their word, when they said they would get back with me they did exactly what they said every time. I highly recommend this firm to anyone.”
What Probate Means in Texas
Probate is the legal process used to handle a deceased person’s estate. In Texas, that can involve proving the validity of a will, appointing the person who will handle the estate, identifying estate assets, dealing with debts and creditors, and distributing property according to the will or, if there is no will, according to Texas law. The Texas State Law Library describes formal administration as the process in which the court validates the will, if there is one, and appoints someone to handle the person’s assets and estate matters.
When a Will Needs to Be Filed
In Texas, there is generally a four-year period to file a will for probate. The Texas State Law Library explains that after that point, the will may be treated as invalid for ordinary probate purposes and property may instead pass as though there were no valid will, unless a limited exception applies.
Because probate deadlines can matter so much, it is important not to wait too long to get legal advice if you believe an estate needs to be opened.
Probate Without a Will
If someone dies without a valid will, Texas intestacy laws control who inherits. That means the estate passes according to statutory rules rather than the person’s own written instructions. In those situations, questions often arise about who should administer the estate, what property is part of the estate, and how heirs should be identified.
Many families want to avoid leaving those decisions entirely to default legal rules. That is one reason probate and estate planning often go hand in hand.
Assets That May Pass Outside Probate
Not every asset always goes through probate. Certain assets may pass directly to a named beneficiary depending on how they were set up. This can include some accounts, insurance proceeds, or other assets with beneficiary designations. That is why part of probate administration often involves figuring out which assets are probate assets and which are not.
