Child Support Guidelines in Texas

Texas uses statutory child support guidelines based primarily on the obligor’s net monthly resources. Texas Law Help explains that the basic guideline percentages are generally 20% for one child, 25% for two children, 30% for three children, 35% for four children, and 40% for five or more children. The same source also notes that guideline support is currently capped using the first $11,700 of the obligor’s monthly net resources, unless the proven needs of the child support a higher amount.

Texas also recognizes lower-income guideline tables in some situations. Texas Law Help explains that different low-income percentages can apply when the obligor has $1,000 or less in monthly net resources.

While the guidelines are the starting point, child support is not always as simple as plugging numbers into a formula. Issues such as underemployment, multiple households, medical needs, educational costs, and other child-specific circumstances can affect the final outcome.

Establishing Fair Child Support

Child support is intended to help provide for a child’s day-to-day needs and overall well-being. In many cases, one parent is ordered to make regular payments to the other parent to help cover the costs of housing, food, clothing, school-related expenses, and other support obligations.

At Roger G. Jain & Associates, P.C., we help parents address child support issues carefully and strategically. That includes reviewing income information, examining the facts that may justify a deviation from the guidelines, and making sure the calculations are based on accurate financial information.

Child Support Modification and Enforcement

Child support orders are not always permanent in practice. A parent may lose a job, experience a major income change, or face new circumstances affecting the child’s needs. In other situations, one parent may stop paying as ordered, creating financial pressure on the household that depends on that support.

Texas Law Help explains that child support may be modified when there has been a material and substantial change in circumstances, and it also notes that a review may be possible when enough time has passed, and the current amount differs from the guideline amount by a sufficient margin.

Our firm helps clients with both sides of these disputes. We assist parents who need to enforce support orders, and we also help parents who need to seek a lawful modification instead of falling behind and creating larger legal problems.
