What Is Spousal Support?

Spousal support, often called spousal maintenance in Texas, is financial support that may be ordered in limited divorce situations. Its purpose is not to guarantee a permanent lifestyle match. Instead, Texas law focuses on whether a spouse can meet minimum reasonable needs and whether the legal requirements for maintenance are satisfied.

For many families, support becomes an issue because one spouse paused a career, earned substantially less during the marriage, cared for children, or needs time to become financially self-supporting after the divorce. These cases are highly fact-specific, and the outcome often depends on the quality of the evidence presented.

How Spousal Maintenance Works in Texas

Texas courts consider a range of factors when deciding whether maintenance is appropriate and, if so, the amount and duration. Those factors can include each spouse’s ability to provide for minimum reasonable needs, education and employment skills, the duration of the marriage, age, employment history, physical and emotional condition, homemaker contributions, and whether family violence or marital misconduct is involved.

Texas also places a cap on court-ordered maintenance. A court generally may not order monthly maintenance greater than the lesser of $5,000 or 20% of the paying spouse’s average monthly gross income. Texas law also limits duration in many cases, often with maximum periods of five, seven, or ten years, depending on the length of the marriage and the legal basis for maintenance. However, some disability-related situations may be treated differently.

Establishing or Contesting Spousal Support

Spousal maintenance is rarely automatic and is often one of the most contested aspects of a divorce. One spouse may believe support is necessary to transition forward. The other may believe the request is too high, too long, or unsupported by the facts.

At Roger G. Jain & Associates, P.C., we help clients on both sides of these disputes. We work to gather the financial records, employment information, and other evidence needed to build a clear position, whether you are asking the court to award support or fighting to limit an unfair request.

Modifying Existing Spousal Support Orders

Life changes can make an existing order no longer workable. A job loss, major income shift, remarriage, disability, or other substantial change may justify seeking a modification. Texas law also provides that maintenance generally terminates upon the remarriage of the receiving spouse, and cohabitation can also become an issue in some cases.

Our firm helps clients review whether modification or termination may be available and how to present that request effectively.
