What a Texas DWI Charge Can Put at Risk
In Texas, a person is legally intoxicated at a 0.08 BAC, but the state can also prosecute when alcohol or drugs have affected normal use of mental or physical faculties. According to TxDOT, a first DWI offense can bring up to $2,000 in fines, up to 180 days in jail with a mandatory minimum period, and loss of driver license up to one year. Texas Penal Code Chapter 49 also treats DWI as a Class B misdemeanor in general, with enhancement in certain situations, including when the alcohol concentration is 0.15 or more, and it separately addresses more serious offenses such as intoxication assault and intoxication manslaughter.
Repeat allegations, high BAC results, accidents, injuries, minors in the vehicle, or prior history can make a DWI case much more serious. That is why early defense work matters. A charge that may look straightforward at first can have lasting consequences if it is not challenged properly.
Protecting Your License After a DWI Arrest

Texas DPS explains that the Administrative License Revocation (ALR) Program is a separate civil process that can suspend your license after a DWI-related arrest. DPS also states that you generally have 15 days from service of the suspension notice to request a hearing. In many cases, that hearing timeline is critical. Texas also allows some drivers to seek an occupational license in appropriate situations, which can permit limited driving for essential needs when available by court order.
