What Is Spousal Support?

Spousal support, often called spousal maintenance in Texas, is financial support that may be ordered in limited situations after or during a divorce. Its purpose is not to guarantee a permanent lifestyle match. Instead, Texas law focuses on whether a spouse can meet minimum reasonable needs and whether the legal requirements for maintenance are satisfied.

For many families, support becomes an issue because one spouse paused a career, earned substantially less during the marriage, cared for children, or needs time to become financially self-supporting after the divorce. These cases are fact-specific, and the right result often depends on the quality of the evidence presented.

How Spousal Maintenance Works in Texas

Texas courts consider a range of factors when deciding whether maintenance is appropriate and, if so, the amount and duration. Those factors include each spouse’s ability to provide for minimum reasonable needs, education and employment skills, the duration of the marriage, age, employment history, physical and emotional condition, homemaker contributions, and whether family violence or marital misconduct is involved.

Texas also places a cap on court-ordered maintenance. Under the Family Code, a court generally may not order monthly maintenance greater than the lesser of $5,000 or 20% of the paying spouse’s average monthly gross income. The duration is also limited by statute, often with maximum periods of five, seven, or ten years depending on the length of the marriage and the basis for the award, although some disability-related cases may be treated differently.
